Asbestos Claims and the Economy – Mesothelioma Asbestos Diseases

The Scottish economy could be facing a devastating impact from asbestos exposure related claims. The warning came as delegates from the construction industry attended a McGrigor Donald seminar in Glasgow today (4 December) and were told that the experience in the US could indicate that asbestos litigation is a timebomb for the Scottish economy.

Currently 3,000 people die from asbestos-related diseases in the UK each year but this is expected to rise by over 300% in the next seven years to 10,000 deaths per year.

Gavin Paton, Associate with McGrigor Donald’s Construction and Engineering team warned that the UK could follow a similar pattern to asbestos litigation in the US, where many companies have been left bankrupt as a result.

“The US has experienced a surge in asbestos related claims leaving a number of companies involved bankrupt. Although there is a concern that this trend might filter across the Atlantic, especially with the growing claims culture in the UK, there are a few fundamental differences between US and UK law and legal process.

These differences mean that the experience in the UK is unlikely to be so devastating.

“Although it is impossible to prevent claims from being made, it is crucial that companies comply with the requirements of the legislation and keep records so that they can prove that they have taken the necessary steps such as supplying workers with masks and implementing and maintaining risk management procedures.”

The seminar also looked at future legislation on corporate killing. Laura Cameron, Director with McGrigor Donald’s Commercial Litigation team reviewed the recent Transco case and outlined the impact this may have for future legislation on corporate killing – a key area of concern for the construction industry which suffers more fatalities each year than any other industry.
